美国国会提案制定《2009年BPA消费者信息法》，对《xx食品、药品和化妆品法》进行修改。它要求所有整体或部分含有双酚A或可能向食品释放双酚A的食品容器在标签上注明警告语。

挑战：

法案要求修改《xx食品、药品和化妆品法》(21 U.S.C. 343)第403部分“标签错误的食品”，增加以下新条款：

如果食品容器 —
1. 整体或部分含有双酚A或可能向食品释放双酚A；
2. 在需要的情况下，没有按法规要求的方式在标签上注明容器整体或部分含有双酚A或可能向食品释放双酚A的警告。

本法仅适用于本法生效6个月后在美国进行州际贸易的食品。

威斯康星州禁止在儿童用容器中使用双酚A

威斯康星州已通过了一项禁止在儿童用容器中使用双酚A的法规。该法规将于颁布日期2010年3月17日后第90天开始生效。

挑战：

法规的主要内容是：

1. 任何人不得生产、以批发的形式销售或为销售供应含有双酚A的儿童用容器。

• 为零售供应儿童用容器的生产商或批发商应确保容器标签上清晰地注明不含有双酚A；
• 并非为零售供应儿童用容器的生产商或批发商应确保做到以下其中一项：
       - 确保容器标签上清晰地注明不含有双酚A；
       - 向买方确认容器不含有双酚A。

2. 任何人不得以零售方式销售或为销售供应含有双酚A的儿童用容器。

• 以零售方式销售或为销售供应儿童用容器的任何人应确保容器标签上清晰地注明不含有双酚A。

但是，这一要求不适用于二手儿童用容器的销售。

备注：在本法案中，“儿童容器”指为3岁或以下儿童使用而生产的空的婴儿瓶或防渗露杯。

US Congress and Wisconsin State Restrict Use of Bisphenol- A

US Congress Proposes the "BPA Consumer Information Act of 2009"

The US Congress has proposed the "BPA Consumer Information Act of 2009" to amend the Federal Food, Drug and Cosmetic Act. It requires a warning on the label of any food container that is composed, in whole or in part, of bisphenol-A or could release bisphenol-A into food.

The Challenge:

The bill requires to amend Section 403 "Misbranded Food" of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 343) by adding the following new clause:

If its container -
1. is composed, in whole or in part, of bisphenol-A or could release bisphenol-A into food;
2. fails to display, in such manner as the Secretary may require, a warning on the label that states the container is composed, in whole or in part, of bisphenol-A or could release bisphenol A into food, as applicable.

It shall apply only with respect to food that is introduced or delivered for introduction into interstate commerce on or after the date that is 6 months after the date of the enactment of this Act.

Wisconsin Bans Bisphenol-A in Child's Containers

The State of Wisconsin has passed the bill prohibiting the use of bisphenol-A in children's containers. This law shall be effective on the 90th day beginning after its publication date March 17, 2010.

The Challenge:

1. No person may manufacture or sell, or offer for sale, at wholesale, a child’s container that contains bisphenol-A.

• A manufacturer or wholesaler who sells or offers for sale a child’s container that is intended for retail sale shall ensure the container is conspicuously labeled as not containing bisphenol-A;
• A manufacturer or wholesaler who sells or offers for sale a child’s container that is not intended for retail sale shall do one of the following:
       - Ensure that the container is conspicuously labeled as not containing bisphenol-A;
       - Confirming the buyer that the container does not contain bisphenol-A.

2. No person may sell, or offer for sale, at retail a child's container that contains bisphenol-A.

• A person who sells or offers for sale at retail a child's container shall ensure the container is conspicuously labeled as not containing bisphenol-A.

However, this requirement does not apply to the sale of a used child’s container.

Notes: For the purpose of the bill, "Child's container" means an empty baby bottle or spill?proof cup primarily intended by the manufacturer for use by a child 3 years of age or younger.
