通过铁路，水路，航空运输烟花爆竹的，按照铁路，水路，航空运输安全管理，有关法律，法规，规章为准。

由道路运输烟花爆竹23日，托运人应当交出的县级人民政府公安部门提出申请，并提交下列有关材料：

（一）对从事危险货物运输承运人证明其资格;

（二）司机，在认证从事危险货物运输护送工人;

（3）危险货物道路运输车辆的运输证明;

（四）从事烟花爆竹生产，经营资格的托运人证明文件;

（5烟花）的购销合同和运输烟花爆竹的种类，规格，数量;

（6）烟花爆竹产品质量和包装认证;

（7）运输车辆，等级，运输时间，起始地点，驾驶路线，停车地点。

对公安机关受理的第24次申请，须在3天内接受申请，从提交检讨有关材料之日起，以满足要求，“烟花爆竹，道路运输许可证”的发放;不符合条件，应当说明理由。

“烟花爆竹道路运输许可证”应当载明托运人，承运人，一次性运输有效期限，起始地点，行驶路线，停车地点，烟花爆竹，类型，大小和数量。

通过公路运输烟花爆竹25日，除应符合“人民共和国的中国道路交通安全法”，也应当遵守下列规定：

（1）机上，“烟花爆竹，道路运输许可证”;

（2）不得违反运输许可事项;

（3）交通警示标志与易燃易爆危险品的国家标准的车辆，暂停或符合安装;

（四）烟花符合国家标准和规范装载;

（5）装载烟花爆竹的，不得载人舱室;

（6）车速限制公路运输车辆，途中必须停止载人;

（7）危险情况立即采取必要措施，并报告当地执法机构。

烟花爆竹26日到达目的地后，收货人应3年的“烟花爆竹，道路运输许可证”的日子注销返回到发证机关。

禁止烟花27乘搭公共交通工具。

禁止张贴烟花爆竹禁止在托运行李，包裹，邮件中夹带烟花爆竹。

安全排放

章对燃放烟花爆竹28日，应符合有关法律，法规和规章。地方各级人民县级以上的行政区域根据实际情况，以确定政府限制或禁止燃放烟花爆竹的时间，地点和类型。

各国政府29日在各级政府有关部门应进行社会宣传运动，教育市民遵守有关法律，法规和规章，安全燃放烟花爆竹。

广播，电视，报纸等新闻媒体，应当做好烟花爆竹安全宣传，教育。

对未成年人的监护人应当对未成年人的安全烟花爆竹的教育。

第三十条禁止在下列地点燃放烟花爆竹：

（一）文物保护单位;

（二车站，码头，机场和其他运输）枢纽以及铁路线路安全保护区;

（三）的易燃，易爆物资的生产，储存单位;

（四）输电设施，安全保护区;

（5）医疗机构，幼儿园，老人小学和中学，家园;

（6）森林，草原，和其他主要火区;

（七）县级以上的禁止燃放烟花爆竹，其他地区的地方人民政府。

第三十一条燃放烟花爆竹应当按照燃放出院依照指示，在不危及安全地公共安全和人身，财产，燃放烟花爆竹。第32条

，以及其他大型焰火燃放烟花爆竹的组织活动，应按照时间，地点，环境，活动，规模和烟花爆竹，规格和数量型的性质，确定风险程度，管理的实施在不同的层次。具体措施在不同层面由国务院公安部门管理。第

申办第33届，以及其他大型焰火晚会燃放烟花爆竹活动，主办单位应当按照分级管理的规定，在公安部门对有关人民政府提出申请，并提交下列有关材料：

（一）组织烟花爆竹以及其他的活动，大型燃放烟花爆竹的时间，地点，环境，活动的规模性质;

（二）烟花，规格，数量，类型;

（ c）在业务方案放电;

（四排放作业单位，经营者），工业-标准规定条件的证明。

接受了公安部门的申请，须接受20天内提交对审查有关申请材料之日起，以满足要求，“许可证签发的燃放烟花爆竹”，不符合条件，要的原因。

34日晚的烟花，以及其他大型焰火燃放活动燃放作业单位和操作人员应按照规定和烟花爆竹安全根据载起飞的排放许可证排放运作程序操作。

第三十五条公安部门应当加强对高风险水平，以及其他大型焰火晚会燃放烟花爆竹的监督和检查活动。

第六章法律责任第三十六条

擅自生产，经营烟花爆竹制品，或者未取得烟花爆竹安全许可的单位或者个人销售黑火药，烟火药，引信，以及安全监督管理部门责令停止违法行为生产经营活动，在20000元的不超过10万元以下的罚款，以及非法生产经营没收物品及违法所得。对未经批准的烟花爆竹道路运输

公安部门责令停止非法运输活动，处1万元以上5万元以下的罚款，以及商品和违法所得没收非法运输。

非法生产，经营，运输烟花爆竹，构成违反治安管理行为，违反了治安管理处罚依法构成犯罪的，依法追究刑事责任。

烟花爆竹的生产，是第37次，有下列行为的企业安全生产监督管理部门，其中责令限期改正，处1万美元的IT或以上5万元以下的罚款;逾期未改正的，责令停止整顿，情节严重的，安全生产许可证被撤销：

（一）不按照安全生产与生产许可证核准的产品范围;

（二生产过程或生产经营）不符合有关国家标准，行业标准;

（3）就业的城市，成为不设区人民政府安全生产监督管理部门在评估过程中的危险经营的人才;

（4）在烟花爆竹不符合国家标准要求使用的原料生产或使用超过国家标准的限制使用要求的原材料;

（5）根据禁止使用或物质的烟花爆竹生产禁忌兼容国家标准规定的使用;

（六）不按照与燃放烟花爆竹的规定表明，在产品上标注的国家标准，或者是在烟花爆竹包装上没有易燃易爆危险物品警示标志印制。

在烟花爆竹批发企业在从事的经营者和烟花爆竹，或供应非法生产经营零售供应按照国家标准进行了第38次要求由专业燃放人员烟花爆竹，并经安全生产监督管理部门责令停止违法活动，在2.0万元的不超过10万元以下的罚款，并没收非法物品和违法所得，情节严重的，吊销许可证烟花。

从事烟花爆竹零售经营者和非法生产的烟花，在出售时，按照国家标准或操作需要销售人员的专业燃放烟花爆竹，由安全生产监督管理部门责令停止违法行为，从1000人民币5000元以下的罚款，以及对非法物品和违法所得，没收，情节严重的，吊销许可证烟花。

第39次生产，经营，使用黑火药，烟火药，引信的业务，黑火药的损失，烟花爆竹药，引信不及时向当地安全生产监督管理部门和公众安全的企业部门，公安部门报告主要负责人，从5000至超过2万元以下的罚款丢失的物品收回。

通过公路运输烟花爆竹的，由公安部门有下列行为之一的第40次责令200元以上2000元以下的改正，并处：

（一运输许可事项）的行为;

（2）服务员携带“烟花爆竹道路运输许可证”;

（3）运输车辆没有悬挂或警告标志易燃易爆危险物品符合国家标准安装;

（四）装载烟花爆竹不符合国家有关标准和准则一，

（5）装载烟花爆竹的车厢载人;

（6）在每危险货物运输车辆旅行时间超过了规定;

（7）运输车辆的道路上没有停止载人;

（八）目的的方式到来，到指定的时间没有将“烟花爆竹道路运输许可证”注销发证机关的回报。

第四十一条执行权由公安部门没收烟花爆竹非法携带，邮寄，烟花爆竹夹带在公共交通工具，或邮寄烟花爆竹的夹带烟花爆竹以及在托运的行李，包裹，邮件，可以并处200元以上1000元以下的罚款。第42条

擅自举办焰火晚会以及其他大型焰火燃放活动，或者焰火晚会以及其他大型焰火燃放活动燃放作业单位和操作人员违反安全程序谁燃放烟花的燃放作业程序公安部门执行行动责令停止燃放，对科一百万以上的负责单位或五万元以下的罚款。

禁止烟花爆竹的时间，地点和燃放烟花爆竹，或危及公安部门公众安全和人身财产安全的方式烟花责令停止排放为100元，500元以下的罚款;构成违反安全管理做法，治安管理处罚的法律制裁。第43条

没收的非法烟花爆竹以及生产和废物处置烟花爆竹企业，应当密封，由公安部门销毁或处置现场。

安全生产监督管理部门，公安部门，质量技术监督部门，工商行政管理44部门的工作人员在烟花爆竹安全监管工作，滥用职权，玩忽职守，徇私舞弊，构成犯罪的，依法追究刑事责任;尚不构成犯罪的，依法给予行政处分。第七章附则

的“烟花爆竹安全生产许可证”，“烟花爆竹经营（批发）许可证”，“烟花爆竹经营（零售）许可证”，由安全生产监督管理部门，国务院根据风格，“烟花爆竹，道路运输许可证“，”烟花爆竹燃放许可证“由国务院，作风公安部门。

第46条本条例自发布之日起施行。（完）
